Acceptable Use Policy (AUP)

1. General Use Terms

1.1 Using any NixServers services to run IRC or IRC bots, BNC accounts, proxy servers, tor servers, any hacking or cracking software, any pirated or unlicensed software, storing any data on which the customer does not have rights to do so, illegal pornography, sending SPAM / UCE, running any P2P or file sharing applications, using the servers for streaming without prior consent, publicly sharing files over which the customer does not have rights to do so, using improper language when communicating to NixServers employees is considered a violation of the AUP and leads to immediate and without notice account termination with no refunds.

1.2 Using NixServers services in any illegal way is strictly forbidden and is considered a violation of the AUP which leads to immediate and without notice account termination with no refunds.

1.3 Using NixServers services by which prejudice is created for other customers or their equipment or software is considered a violation of the AUP which leads to immediate and without notice account termination with no refunds.

1.4 Folosirea oricăror servicii NixServers prin care se generează trafic în scopul atacării sau obţinerii de acces neautorizat  sau informaţii asupra cărora clientul nu are drepturi de acces pe oricare alt echipament care nu este proprietatea clientului, în reţeaua NixServers sau în Internet, atrage după sine procedurile administrative de investigare tehnică a echipamentului care a generat traficul în cauză, predarea tuturor informaţiile obţinute în urma investigării către autorităţi şi este considerată o încălcare a "Politicii de acceptanţă" (AUP) ce duce la terminarea imediată, fără preaviz şi fără posibilitatea de ramburs parţial sau total al sumelor contractate și a contului clientului.

1.5 Bringing offenses through any means to NixServers or its employees, business partners, suppliers or customers is considered a violation of the AUP which leads to immediate and without notice account termination with no refunds.

2. VPS Services

2.1 Overusing the allocated resources for any VPS (abusing the resources by generating a load higher than 1.0 per VPS) will lead to the customer being notified by NixServers tehnical staff for service optimization or upgrade.

2.2 Other abuses: consuming more than 1000000 (one million) inodes; generating more than 200 simultaneous processes for more than 10 minutes; sustained usage of I/O buses; using more than 200 sockets.

2.3 The lack of technical possibility to optimize the current services or the customer's refusal to upgrade or conform to the technical usage guides specified at 2.1 and 2.2. is considered a violation of the AUP which leads to immediate without prior notice account termination with no refunds.

3. Colocation And Dedicated Servers

3.1 Bringing in the colocation space of any materials (eg: liquids, explosives, guns, jamming devices etc.) that can prejudice NixServers in any way is a violation of the AUP which leads to immediate and without notice account termination with no refunds.

3.2 Any prejudice of any type brought to any other customer, business partner, individual or their equipments which are present in the colocation space is considered a violation of the AUP which leads to immediate and one day notice account termination with no refunds.

4. Web Hosting And Limited Resources

4.1 For all shared hosting accounts the following are considered a violation of the AUP which lead to immediate account suspension:

4.1.1 Constant usage of more than 10% of any of the shared server's resources; NixServers can choose to apply manual or automatic limitations instead of suspending the account depending on the case.

4.1.2 Usage of the shared hosting account for public or private file hosting; the shared hosting accounts can only be used for hosting websites.

4.1.3 Usage of the shared hosting account to run (or store) the following types of applications: web spider, IRC, any type of P2P (eg: torrents), real-time games, proxy servers or clients.

4.1.4 Using the shared hosting account in a manner that consumes more than 250000 inodes.

4.2 NixServers reserves its right to limit the shared hosting accounts as it seems appropriate to resume and ensure quality hosting conditions for all the customers on any of its shared hosting servers.

4.3 The resource barriers set by default for the web hosting accounts are as follow:

• EP: Entry processes, CPU: CPU time, MEM: total allocated RAM
• Personal: EP: 10, CPU: 10%, MEM: 1GB
• Commercial: EP: 15, CPU: 15%, MEM: 1GB
• Professional: EP: 25, CPU: 25%, MEM: 1GB
• Reseller: EP: 25, CPU: 25%, MEM: 1GB

4.4 In case of website migration services NixServers takes no responsability regarding the partial or total integrity or consistency of the data being migrated to our servers.

4.5 In case of hacking or denial of service attacks NixServers reserves its right to partially or totaly modify the customer's data in order to protect the shared server. This includes and is not limited in any way to terminating the customer account without notice.

4.6 The shared hosting accounts may only be used for hosting websites under the technical and commercial specifications on the NixServers website.

5. Data Backup

5.1 NixServers offers its customers the possibility of backing up their data in different ways depending on their ordered service.

5.2 The backup types may vary from case to case from one time backup, to periodical backup or real-time backup.

5.3 NixServers will implement best-effort practices to make sure that the integrity and consistency of the backups on its servers is as close to the customer's real-time data. As this is a preventive service customers are advised to manually backup up their data on their own systems.

6. Customer Selection Right

6.1 NixServers reserves its right to refuse, suspend, terminate or cancel any service in case of AUP violation.

6.2 All customers who wish to use NixServers services must be in complete approval at all times to all the terms in this document.

6.3 Failing to respect any of the terms in the AUP is reason enough for immediate termination of any of the customer's ordered services that are in violation of the terms detailed in this document.
